Corruption, now, just not as a personal crime, but as a sistemic and collective crime. So, a solution of it isn’t enought just with positive law approach—criminal law-- and leaves nets of roots of corruptor and corrupt culture in midst of society. Act of corruption must be traced to its roots. Besides that, with consistency, reconstructing a culture—like habit, paradigm, social understand, etc-- in midts of society.
Needs a courages to change the appearance of bureaucrat and repair culture of society. They—as lookly—deem corruption as the usual of habit. A clean bureaucrat of government came fom a clean social order of society.
Islam, as a revolusioner religion since came, must to take potition to wipe out its crime. Islam doesn’t be a silent doctrine and looks a suffering billion of people (masses) as result of act of corruptor in this state. Therefore, something can do by moslem to annihilate act af corruption deemed as jihad (social duty) and its value is better than jihad against Kuffar (man out of Islam).
Nahi munkar about corruption, one of it, is reconstructing (or deconstructing) all tafsir (one of models of interpretation of Qur’an and Hadits in Islam) interrelated its and tried its relevance in context. ‘ulama, religionist, moslem intellectual and santri (moslem student) must be an actor to repair the ‘ummah culture from act of corrupt. Therefore, education, one of many way, is significant point to ease get purpose repair and clean social culture. Education can to change people paradigm to be better understanding about reality, priority corruption. So, sifting paradigm must to do, one of it, with change civil understanding to these concept of theology in Islam. Theology, doesn’t be a silent doctrine and have not means that able to change the world, but must be revolusioner. Piety of religion not means good devine service, but good social attitude too.
Punish with amputate a hand, in Islam canon law, must interpreted more than as usual condition (al-Maidah: 38). It verse must interpreted as amputate all of roots of corruptors, likes them strong and power.
Therefore, two approach—law of state and law of society with repair a culture of society—is a good solution and needs to “landing” in reality. But, social approach to againts act of corrupt will be discuss, more interest to get big portion. Very Interesting, to discuss something interelated with pesantren (Islamic boarding school): its potition and contribution to repair culture of society (priority moslem society).
